END-USER LICENSE AGREEMENT (EULA)
This End-User License Agreement (“EULA”) is a legally binding agreement between you (“you,” “your,” or “User”) and YewScripts (“us,” “we,” or “our”). This EULA governs your access to and use of any and all scripts, code, instructions, enhancements, custom configurations, related materials, or services (“Scripts”) provided by YewScripts that are compatible with, designed for use with, or intended to be run on a Cronus Zen device. This EULA also applies to any updates, upgrades, modifications, patches, or supplements to the Scripts (collectively, the “Services”).
READ THIS EULA CAREFULLY BEFORE DOWNLOADING, INSTALLING, OR USING THE SCRIPTS. BY ACCESSING, DOWNLOADING, INSTALLING, USING, OR OTHERWISE INTERACTING WITH THE SCRIPTS, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY ALL TERMS OF THIS EULA AND OUR PRIVACY POLICY, INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT AGREE TO ANY OF THE TERMS OF THIS EULA, DO NOT USE THE SCRIPTS.
1. License Grant
Subject to your continuous compliance with this EULA, YewScripts grants you a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download, install, and use the Scripts solely for your personal, non-commercial use. You acquire no ownership interest in the Scripts. All rights not expressly granted herein are reserved by YewScripts.
2. Use Restrictions
You agree that you shall not, and shall not enable or permit any third party to:
• Use the Scripts in any manner that violates any applicable law, regulation, or order, or that breaches any third-party terms of service, end-user license agreement, acceptable use policy, code of conduct, or any other contractual obligation (“Third-Party Terms”). This includes, without limitation, any video game’s terms of service or EULA.
• Use the Scripts in any public matches, ranked or competitive modes, tournaments, esports events, or any environment where use of such Scripts is prohibited or provides an unfair advantage.
• Use the Scripts to cheat, gain unfair advantages, automate inputs unfairly, reduce recoil beyond normal human capability, or otherwise engage in gameplay behavior disallowed by the respective game developer, publisher, platform, or service.
• Modify, reverse engineer, decompile, disassemble, decrypt, translate, or create derivative works from the Scripts, in whole or in part, except to the extent expressly permitted by applicable law.
• Resell, rent, lease, license, sublicense, distribute, assign, transfer, host, or commercially exploit the Scripts without the prior written consent of YewScripts.
• Remove, alter, or obscure any proprietary notices, labels, or marks on the Scripts.
3. Compliance with Third-Party Terms
You acknowledge that your use of the Scripts may interact with third-party software, services, games, or platforms. It is your sole responsibility to ensure that your use of the Scripts complies with all Third-Party Terms. You understand and agree that using the Scripts in violation of any game’s or platform’s rules may result in penalties including but not limited to account suspension, bans, or other enforcement actions by third parties. YewScripts disclaims all liability arising from your breach of any Third-Party Terms.
4. Intellectual Property Rights
All intellectual property rights (including but not limited to copyrights, patents, trademarks, and trade secrets) in and to the Scripts are owned by YewScripts or its licensors. This EULA does not grant you any title, interest, or ownership in the Scripts, nor does it grant you any right to use YewScripts’ trademarks, service marks, or logos.
5. Privacy
Your use of the Scripts is subject to YewScripts’ Privacy Policy, which is available at https://yewscripts.com. By using the Scripts, you acknowledge that you have read and understand our Privacy Policy, and you consent to the collection, use, and disclosure of information as described therein.
6. Updates and Changes
YewScripts may provide patches, bug fixes, updates, upgrades, or modifications (“Updates”) to improve or enhance the Scripts, at its sole discretion. These Updates may be installed automatically without additional notice. Unless separate terms accompany the Updates, this EULA applies to all such Updates. YewScripts reserves the right to modify, suspend, or discontinue the Scripts, in whole or in part, at any time without liability to you.
7. Assumption of Risk and User Responsibility
You understand and agree that using the Scripts may result in consequences imposed by third parties, including without limitation bans, suspensions, or other penalties by game developers, publishers, or platform holders. You assume all risk associated with using the Scripts. YewScripts does not advocate, endorse, or encourage any use of the Scripts that violates game rules or applicable laws.
8. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SCRIPTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND DEFECTS, WITHOUT WARRANTIES, REPRESENTATIONS, OR GUARANTEES OF ANY KIND. YEWSCRIPTS AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, QUIET ENJOYMENT, OR ACCURACY. YEWSCRIPTS DOES NOT WARRANT THAT THE SCRIPTS WILL BE UNDETECTABLE, ERROR-FREE, UNINTERRUPTED, COMPATIBLE WITH ANY PARTICULAR DEVICE, GAME, OR PLATFORM, OR THAT THEY WILL MEET YOUR REQUIREMENTS.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL YEWSCRIPTS OR ITS AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SCRIPTS, EVEN IF YEWSCRIPTS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, YEWSCRIPTS’ TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THIS EULA OR YOUR USE OF THE SCRIPTS SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID (IF ANY) FOR THE SCRIPTS GIVING RISE TO THE CLAIM, OR (B) TEN U.S. DOLLARS (USD $10).
10. Indemnification
You agree to indemnify, defend, and hold harmless YewScripts, its affiliates, officers, directors, employees, agents, partners, licensors, and service providers from and against any and all claims, demands, actions, losses, damages, judgments, awards, costs, expenses, and liabilities (including reasonable attorneys’ fees) arising out of or related to (a) your use or misuse of the Scripts; (b) your violation of this EULA; (c) your breach of any Third-Party Terms; (d) your violation of any applicable laws, rules, or regulations; or (e) your infringement of any third-party right.
11. Governing Law and Jurisdiction
This EULA shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to conflict of law principles. You irrevocably submit to the exclusive jurisdiction of the courts located in [Your Jurisdiction] for any disputes arising out of or related to this EULA or the Scripts. You waive any objections to such jurisdiction or venue.
12. Severability
If any provision of this EULA is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to render it enforceable, and the remaining provisions shall remain in full force and effect.
13. Entire Agreement
This EULA, including our Privacy Policy and any other terms incorporated by reference, constitutes the entire agreement between you and YewScripts regarding the Scripts and supersedes all prior oral or written communications, proposals, and representations.
14. No Waiver
Any delay or failure by YewScripts to exercise a right or enforce a provision under this EULA shall not be deemed a waiver of that right or provision. A waiver is only effective if in writing and signed by an authorized representative of YewScripts.
15. Assignment
You may not assign or transfer this EULA or any rights or obligations herein, in whole or in part, without the prior written consent of YewScripts. Any attempt to assign or transfer without such consent shall be void.
16. Termination
This EULA is effective until terminated. You may terminate this EULA at any time by ceasing all use of the Scripts and destroying all copies. Your rights will automatically terminate without notice if you fail to comply with any of the terms of this EULA. Upon termination, you must immediately stop using the Scripts and destroy all copies. Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law shall survive termination.
